Sydney Town Grant

By His Excellency Lachlan Macquarie Esquire Captain General and Governor in Chief of His Majesty's Territory of New South Wales and its Dependencies &c, &c, &c

Whereas full Power and Authority for Granting Lands in the Territory of New South Wales is vested in His Majesty's Captain General and Governor in Chief (or in his absence the Lieutenant Governor for the time being) in and over the Said Territory and its Dependencies by His Majesty's Instructions under the Royal Sign Manual bearing Date respectively the Twenty fifth Day of April One Thousand Seven hundred and eighty Seven, and the Twentieth Day of August One Thousand Seven hundred and eighty nine -

In Pursuance of the Power and Authority vested in Me as aforesaid I Do by these Presents Give and Grant unto Mary Reiby, her Heirs and Assigns to Have and to Hold For Ever Forty Five Rods of Land lying and situate in the Town of Sydney bounded on the South East side by Macquarie Place bearing North thirty five and three quarters degrees East fifty three feet; On the North East side by a line North forty six Degrees West two hundred and thirty feet; On the North West side in the Cove by a line West forty Degrees South fifty two feet; And on the South West side by a line South forty six Degrees East two hundred and forty two feet touching the Chimney in South end of the House, with the additional use of a Common Cart Road on the North-East side thereof; To be had and held by her the said Mary Reiby, her Heirs and Assigns for Ever; Provided Always, and it is hereby expressly to be understood that the said Mary Reiby the Grantee in these Presents named shall in no wise either directly or indirectly Sell Alienate or Transfer any Part or Parcel of the Land hereby Granted within the space of Three Years from the Date thereof; And also Provided Always that she the said Mary Reiby shall Build or Cause to be built a good and sufficient Dwelling House thereon of Brick or Stone within the space of Three Years from the Date hereof which House shall not be less than fifty feet in Length from Out to Out, nor less than Sixteen feet in Width in the clear, and two Stories high; and reserving at all times the Right of appropriating such part thereof as may be deemed necessary by the Governor for the Time being for the Making and Improving the Streets, and paying to the Governor Annual Quit Rent of One Pound eight shillings and four pence Sterling from the Date hereof; Or in Default thereof the Whole of the said Lot or tenement shall revert to the Crown, and the Grant hereby made shall be held and deemed Null and Void.

In testimony whereof I have hereunder Set My Hand and the Seal of the Territory, at Sydney in New South Wales this twenty-fifth Day of August in the Year of Our Lord One thousand eight hundred and twelve.
