CONDITIONAL PARDON
No. 797

Whereas His Late Most Excellent Majesty King George The Third, by a Commission under the Great Seal of Great Britain, bearing Date the Eighth Day of November, in the Thirty-first Year of His Majesty's Reign, was graciously Pleased to Give and Grant full Power and Authority to the Governor (or, in Case of His Death or Absence, the Lieutenant Governor) for the Time-being of His Majesty's Territory of the Eastern Coast of New South Wales and the Islands thereunto adjacent, by an Instrument or Instruments in Writing, under the Seal of the Government of the said Territory, or as He or They respectively should think fit and convenient for His Majesty's Service, to Remit either Absolutely or Conditionally the Whole or any Part of the Term or Time for which Persons convicted of Felony, Misdemeanor, or other Offences, amenable to the Laws of Great Britain, should have been or should thereafter be respectively Conveyed or Transported to New South Wales, or the Islands thereunto adjacent.

By Virtue of such Power and Authority so vested as aforesaid, I Major General Sir Richard Bourke Captain General and Governor in Chief of His Majesty's said Territory of New South Wales and its Dependencies, and Vice-Admiral of the same, taking into Consideration the good Conduct of William Howden who arrived in this Colony in the Ship Prince of Orange - Silk Master, in the Year One thousand Eight hundred and Twenty one under Sentence of Transportation for Life and whose Description is on the back hereof, Do hereby Conditionally Remit the Remainder of the Term or Time which is yet to come and unexpired of the Original Sentence or Order of Transportation passed on the aforesaid William Howden at Lincoln Assizes on the Fifteenth Day of July One thousand eight hundred and Twenty

Provided Always, and on Condition, that the said William Howden continue to reside within the Limits of this Government for and during the Space of his original Sentence or Order of Transportation :- Otherwise, the said William Howden shall be subject to all the Pains and Penalties of Re-appearing in Great Britain and Ireland, for and during the Term of his original Sentence or Order of Transportation; or, as if this Remission had never been granted.

By Virtue of such Power and Authority so vested as aforesaid, I Sir George Gipps, Knight Captain-General and Governor-in-Chief of Her Majesty's Territory of New South Wales and its Dependencies, and Vice Admiral of the same, taking into consideration the good Conduct of Patrick Keenan who arrived in this Colony in the Ship "Brampton"
Moore Master, in the Year One thousand eight hundred and twenty three under Sentence of Transportation for Life and whose Description is on the back hereof, Do hereby Conditionally Remit the Remainder of the Term or Time which is yet to come and unexpired of the Original Sentence or Order of Transportation passed on the aforesaid Patrick Keenan at County Tipperary on the Summer Assizes One thousand eight hundred and twenty-two.

Provided always, and on condition, that the said Patrick Keenan continue to reside within the Limits of this Government for and during the Space of his Original Sentence or Order of Transportation:- Otherwise the said Patrick Keenan shall be subject to all the Pains and Penalties of Re-appearing in Great Britain and Ireland, for and during the Term of his Original Sentence or Order of Transportation; or, as if this Remission had never been granted.

Whereas Thomas Blackett, Robert Alcock, and Edward Cox alias Bird were at a Court of Criminal Indicature held at Sydney in the Territory of New South Wales on the Ninth day of December 1801 tried and Convicted of Murder and had sentence of Death passed upon them for the same; We in consideration of some favorable circumstances humbly represented unto Us in their behalf are graciously pleased to Extend Our Grace and Mercy unto them and to grant them Our Pardon for their said Crime on Condition of their being kept to hard Labour respectively for three years, and at the expiration of

Whereas John Davis who was originally transported to New South Wales in the year 1814 by the Ship Surry (1) under Sentence for fourteen years, was again tried and convicted in the Criminal Court Sydney on the 27th day of March 1820 for Cattle Stealing and sentenced to be transported for Life, And Whereas some favorable circumstances have been represented to me on his behalf - Now therefore in pursuance of the power vested in me by Royal Commission, I do hereby conditionally remit the remainder of the time or term which is yet to come and unexpired of the said Sentence or Order of transportation passed on the aforesaid John Davis at Sydney on the 27th day of March 1820. Provided always and on condition that the said John Davis continue to reside within the limits of this Government for and during the space of his said Sentence or Order of transportation otherwise the said John Davis shall be subject to all the pains and penalties of his said Sentence or Order of transportation as if this remission had never been granted.

And Whereas some favorable circumstances have been presented unto me on his behalf; Now therefore, in pursuance of the Power vested in me by Royal Commission, I do hereby grant the said Jemmy a Free Pardon for his said Crime.

Van Diemen's Land

To All to whom these presents shall come I, Sir William Thomas Denison Knight, Lieutenant Governor of the Island of Van Diemen's Land and its Dependencies , send Greeting.

No. 341
Whereas Elizabeth Davis was, on the twenty eighth day of February in the Year 1848 at the Central Criminal Court in the County of Middlesex indicted and tried for Larceny and was then duly convicted of the said offence, and upon such conviction was, by the said Court, Sentenced for such offence to be transported for the term of Seven Years, and arrived in this Island under and in pursuance of such sentence in the Year 1848 And Whereas afterwards, in pursuance of the provision in that behalf contained of an Act of Parliament passed in the sixth year of the reign of Her Majesty Queen Victoria, intituled "An Act to amend the Law affecting transported Convicts with respect to Pardons and Tickets of Leave", I the said Lieutenant Governor, by an Instrument in writing under my hand, did recommend the said Elizabeth Davis to Her Majesty for a pardon for her said offence, to be available within all places in Her Majesty's dominions, except the United Kingdom of Great Britain and Ireland, but upon the condition that she should not return to or be found within the said United Kingdom during the said term for which She was so sentenced to be transported as aforesaid - And Whereas Her Majesty hath been pleased, by instructions sent to me by one of Her Principal Secretaries of State, to signify Her approval of such my recommendation - Now Therefore I, the said Lieutenant Governor, in exercise of the power and authority in me by the said Act of Parliament in this behalf vested, and pursuant to the instructions so as aforesaid sent to me by the said Secretary of State, do, by this Instrument in writing under the seal of the Colony of Van Diemen's Land, remit and release to the said Elizabeth Davis the residue of the term for which She was so sentenced to be transported as aforesaid, yet to come and unexpired, and all pains and penalties whatever in respect of the offence whereof the said Elizabeth Davis was so convicted as aforesaid; And do grant unto the said Elizabeth Davis a pardon for her said offence and the firm peace of Our said Lady the Queen available within all places in Her Majesty's dominions, except the said United Kingdom; so that the said Elizabeth Davis may stand clear in all Courts of Justice whatever and elsewhere within such places, if any one should hereafter speak against her touching the said offence whereof She was so convicted as aforesaid Provided always, and these Presents are upon this express condition, that the said Elizabeth Davis shall not, during the period for which She was so sentenced to be transported as aforesaid, return to or be found within the said United Kingdom.

In Testimony whereof I have hereto set my Hand, and caused the Seal of Colony of Van Diemen's Land to be hereunto affixed, at Hobart Town in Van Diemen's Land, this thirteenth day of August in the year of our Lord one thousand eight hundred and fifty three.

By His Excellency Sir John Franklin, Knight Commander of the Royal Hanoverian Guelphic Order, Knight of the Greek Order of the Redeemer, and a Captain in Her Majesty's Royal Navy, Lieutenant-Governor of the Island of Van Diemen's Land and its Dependencies.

Whereas William Hitchcock who arrived at Hobart Town in the Year 1832 by the Ship Lord William Bentinck under a Sentence of Transportation for Life passed upon him at Essex in England in the Year 1831 hath by his good conduct and behaviour during his residence in this Island appeared to me the said Lieutenant-Governor to be a fit object for the extension to him of a Conditional Remission of his Sentence. Now therefore in consideration of the premises I the Lieutenant-Governor aforesaid by virtue of the powers and authorities in me in this behalf vested do by this instrument remit all the residue or remainder of the time or term of Transportation yet to come and unexpired of or under the said Sentence so passed upon the said William Hitchcock as aforesaid upon this express condition nevertheless that the said William Hitchcock do and shall during the whole of such residue of the term of his said original sentence continue and be and reside within the said Island of Van Diemen's Land or it Dependencies anything herein-before contained to the contrary not withstanding.

In testimony whereof I have hereunto set my Hand and caused also the Seal of Van Diemen's Land and its Dependencies to be hereunto affixed at Hobart Town in Van Diemen's Land aforesaid this fourth day of August in the year of Our Lord one thousand eight hundred and forty one

To all to whom these present shall come, I, Charles Joseph Latrobe, Esquire, Administrator of the Government of the Island of Van Diemen's Land and its Dependencies, send Greeting.

Whereas Thomas Johnston was tried at Cambridge in the year 1823 and arrived in this Island in the year 1824 under sentence of Transportation for Life And Whereas Her Majesty hath been pleased to signify to me Her approval, through one of Her Principal Secretaries of State, of a Pardon being granted to the said Thomas Johnston upon condition that he shall not during the said period for which the said sentence was pronounced return to or be found within the United Kingdom of Great Britain and Ireland. Now Therefore I the said Charles Joseph Latrobe do, in pursuance of the instruction to me in that behalf given and sent by the Secretary of State, and of the Act of Parliament, intituled "An Act to amend the Law affecting transported Convicts with respect to Pardons and Tickets-of-Leave," by this instrument in writing under the Seal of the Colony of Van Diemen's Land, grant to the said Thomas Johnston a Pardon, upon the condition that he shall not return or be found within the United Kingdom of Great Britain and Ireland as aforesaid.

By His excellency Sir John Franklin, Knight Commander of the Royal Hanoverian Guelphic Order, Knight of the Greek Order of the Redeemer, and a Captain in Her Majesty's Royal Navy, Lieutenant-Governor of the Island of Van Diemen's Land and its Dependencies.

Whereas Mary Stacey who arrived at Hobart Town in the Year 1836 by the Ship Westmoreland under a Sentence of Transportation for Seven years passed upon him at Somerset in the Year 1836 hath by her good conduct and behaviour during her residence in this Island appeared to me the said Lieutenant-Governor to be a fit object for the extension to her of a Conditional Remission of her Sentence. Now therefore in consideration of the premises I the Lieutenant-Governor aforesaid by virtue of the powers and authorities in me in this behalf vested do by this instrument remit all the residue or remainder of the time or term of Transportation yet to come and unexpired of or under the said Sentence so passed upon the said Mary Stacey as aforesaid upon this express condition nevertheless that the said Mary Stacey do and shall during the whole of such residue of the term of his said original sentence continue and be and reside within the said Island of Van Diemen's Land or its Dependencies anything herein-before contained to the contrary notwithstanding.

In testimony whereof I have hereunto set my Hand and caused also the Seal of Van Diemen's Land and its Dependencies to be hereunto affixed at Hobart Town in Van Diemen's Land aforesaid this twenty eighth day of February in the year of Our Lord one thousand eight hundred and forty-two.

To all to whom these presents shall come, I, Sir William Thomas Denison, Knight, Captain in the Corps of Royal Engineers, Lieutenant-Governor of the Island of Van Diemen's Land and its Dependencies, send Greeting.

Whereas Samuel Astell was tried at Lancaster in the year 1844 and arrived in this Island in the year 1844 under sentence of Transportation for Seven Years And Whereas Her Majesty hath been pleased to signify to me Her approval, through one of Her Principal Secretaries of State, of a Pardon being granted to the said Samuel Astell
upon condition that he shall not during the said period for which the said sentence was pronounced return to or be found within the United Kingdom of Great Britain and Ireland,

To all to whom these presents shall come I, Sir Henry Edward Fox Young, Knight, Captain General and Governor-in-Chief of the Island of Van Diemen's Land and its Dependencies, send Greeting.

No. 957

Whereas Samuel Moss was on the twenty-sixth day of February in the Year 1849, at Abingdon in the County of Bucks indicted and tried for Burglary and was then duly convicted of the said offence, and upon such conviction was, by the said Court, Sentenced for such offence to be transported for the term of Ten Years and arrived in this Island under and in pursuance of such sentence in the Year 1852 And Whereas afterwards, in pursuance of the provision in that behalf contained of an Act of Parliament passed in the sixth year of the reign of Her Majesty Queen Victoria, intituled "An Act to amend the Law affecting transported Convicts with respect to Pardons and Tickets-of-Leave" I, the said Governor by Instrument in writing under my Seal did recommend the said Samuel Moss to Her Majesty for a pardon for his said offence, to be available within all places in Her Majesty's dominions, except the United Kingdom during the said term for which her was so sentenced to be transported as aforesaid. And Whereas Her Majesty hath been pleased, by instructions sent to me by one of Her Principal Secretaries of State, to signify Her approval of such my recommendation, - Now therefore, I, the said Governor in exercise of the power and authority in me by the said Act of Parliament in this behalf vested and pursuant to the instructions so as aforesaid sent to me by the aforesaid Secretary of State, do by this instrument in writing under the seal of the Colony of Van Diemen's Land, remit and release to the said Samuel Moss the residue of the term for which he was so sentenced to be transported as aforesaid yet to come and unexpired, and all pains and penalties whatever in respect of the offence whereof the said Samuel Moss was so convicted as aforesaid, And do grant unto the said Samuel Moss a pardon for his said offence and the firm peace of Our said Lady the Queen available within all places in Her Majesty's dominions, except the said United Kingdom; so that the said Samuel Moss may stand clear in all Courts of Justice whatever and elsewhere, within such places if any one should hereafter speak against him touching the said offence whereof he was so convicted as aforesaid.
Provided always and these Presents are upon this express condition that the said Samuel Moss shall not during the period for which he was so sentenced to be transported as aforesaid, return to or be found within the said United Kingdom.

In testimony whereof I have hereto set my Hand and caused the Seal of the Colony of Van Diemen's Land to be hereunto affixed, at Hobart Town, in Van Diemen's Land this 8th day of July in the year of our Lord one thousand eight hundred and fifty-six.
